INTER-VIVOS TRUSTS
The term ‘inter vivos’ means amongst the living. So, this is a Trust set up during one’s own lifetime as opposed to a testamentary trust set up in terms of a Will, which only comes into being upon death. An Inter Vivos Trust is created during the lifetime of a person by way of an agreement (contract) between the founder (establisher) and the trustees (persons appointed to manage the affairs of the trust) for the benefit of the beneficiaries (the recipients of the income or capital of the trusts).
